1. Service Usage

Welcome to CaptureLife Studios! These Terms and Conditions ("Terms") govern your use of our photography services, including but not limited to portrait sessions, wedding photography, event coverage, and commercial photography. By booking a session with CaptureLife Studios, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use our services.

CaptureLife Studios, located at 2300 Barton Creek Blvd, Suite 500, Austin, TX 78735, is owned and operated by Isabella Rodriguez. We strive to provide high-quality photographic services with professionalism and artistry. Our services are available to individuals and businesses in the greater Austin area. When booking a session, you must provide accurate and complete information. This includes your name, contact details, event details (if applicable), and any specific requirements you may have. CaptureLife Studios reserves the right to refuse service if the information provided is inaccurate or incomplete.

You agree to cooperate with CaptureLife Studios during your session and follow our instructions to ensure the best possible outcome. This includes adhering to the agreed-upon schedule, being on time for your session, and respecting the studio's policies and guidelines.

CaptureLife Studios retains the right to use images from your session for promotional purposes, including but not limited to our website, social media channels, and marketing materials. However, we will always obtain your consent before using any images that personally identify you. If you prefer that your images not be used for promotional purposes, please notify us in writing at the time of booking.

You are responsible for obtaining any necessary permissions or releases for photographing individuals or properties at the session location. CaptureLife Studios is not liable for any claims arising from unauthorized photography.

2. Payment Terms

All prices for CaptureLife Studios' services are listed on our website and are subject to change without notice. The price quoted at the time of booking will be honored, provided that the session details remain the same.

A non-refundable deposit is required to secure your booking. The amount of the deposit will vary depending on the type of session and will be clearly stated at the time of booking. The deposit will be applied towards the total cost of the session.

The remaining balance is due on or before the date of the session. Payment can be made by credit card, debit card, or cash. We do not accept personal checks.

If you need to reschedule your session, you must notify us at least 72 hours in advance. Rescheduling is subject to availability. Failure to provide sufficient notice may result in the forfeiture of your deposit.

In the event that you cancel your session, the deposit is non-refundable. If you have paid the full amount, we will refund the balance minus the deposit amount.

CaptureLife Studios reserves the right to cancel a session due to unforeseen circumstances, such as illness or inclement weather. In such cases, we will provide a full refund or reschedule the session at your convenience.

Additional charges may apply for travel expenses, extended session times, or additional prints and products. These charges will be discussed and agreed upon prior to the session.

3. Intellectual Property

CaptureLife Studios retains all copyright and intellectual property rights to the images created during your session. You are granted a limited license to use the images for personal, non-commercial purposes. This includes printing, sharing on social media, and displaying the images in your home.

You may not sell, modify, or distribute the images for commercial purposes without the express written consent of CaptureLife Studios. This includes using the images in advertising, marketing materials, or for any other business-related purposes.

CaptureLife Studios reserves the right to use the images for promotional purposes, as outlined in Section 1 of these Terms. We will always respect your privacy and obtain your consent before using any images that personally identify you.

If you require a commercial license for the images, please contact us to discuss the terms and conditions. Commercial licenses are subject to additional fees.

You may not remove any watermarks or copyright notices from the images. Doing so is a violation of our intellectual property rights.

4. Liability Disclaimer

CaptureLife Studios is not liable for any injuries, damages, or losses that may occur during your session. You are responsible for your own safety and the safety of your belongings.

We take all reasonable precautions to ensure a safe and comfortable environment for our clients. However, we cannot guarantee that accidents will not happen.

You agree to indemnify and hold harmless CaptureLife Studios, its employees, and its affiliates from any claims, damages, or liabilities arising from your use of our services.

CaptureLife Studios is not responsible for any delays or cancellations caused by factors beyond our control, such as weather conditions, equipment malfunctions, or other unforeseen circumstances. In such cases, we will make every effort to reschedule your session at your convenience.

We are not liable for any errors or omissions in the images created during your session. While we strive to provide high-quality images, we cannot guarantee that every image will be perfect.

Our liability is limited to the amount you paid for the session. We are not liable for any consequential damages or losses.

5. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any disputes arising from these Terms shall be resolved in the state or federal courts located in Travis County, Texas. You agree to submit to the jurisdiction of these courts.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms constitute the entire agreement between you and CaptureLife Studios regarding your use of our services. These Terms supersede any prior agreements or understandings, whether written or oral.

CaptureLife Studios reserves the right to modify these Terms at any time. Any changes will be posted on our website and will be effective immediately upon posting. Your continued use of our services after the posting of any changes constitutes your acceptance of the revised Terms.
